Applies to: hearthrestoration.com and any page that links to these Terms (the “Site”).

These Terms govern use of the website only. Any onsite work, estimates, or services you purchase are governed by our Work Service Authorization (WSA), Master Service Agreement (MSA), job proposals, and signed work orders. If there is a conflict, those signed service documents control.

2) Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction). If you use the Site on behalf of an organization, you represent that you have authority to bind that organization.

3) Site content & ownership

The Site and its contents are owned by Hearth or our licensors and protected by law. We grant you a limited, non‑exclusive, non‑transferable, revocable license to access and use the Site for its intended purposes. Except as permitted by law, you may not copy, modify, distribute, sell, or lease any part of the Site without our written consent.

4) User content; feedback

If you submit content (messages, photos, files), you grant Hearth a worldwide, non‑exclusive, royalty‑free license to host, use, reproduce, and display it solely to operate the Site, respond to your requests, and provide services. You represent you have rights to submit such content. If you provide feedback, we may use it without restriction or compensation.

5) Prohibited uses

  • Unlawful, deceptive, or harmful activity.
  • Unauthorized access attempts or security interference.
  • Uploading malware or infringing/defamatory content.
  • Harvesting data about others without consent.
  • Automated scraping/bots, except public search engines respecting robots.txt.

6) Estimates & no professional advice

Content on the Site is informational only. Online estimates or price ranges are non‑binding and for guidance. Actual scopes, pricing, and timelines depend on site conditions, lab results, codes, insurer requirements, and signed service documents. Nothing here is legal, insurance, engineering, industrial hygiene, medical, or other professional advice.

7) Communications consent

By contacting us, you consent to receive service‑related email/SMS/calls. Marketing requires opt‑in and you may opt out at any time. Message/data rates may apply. Calls may be recorded where allowed by law.

8) Third‑party links & tools

The Site may link to third‑party sites or embed tools (maps, scheduling, payments, chat). Their terms and privacy policies apply to their services. We are not responsible for third‑party content or practices.

10) DMCA / copyright

Send infringement notices to dmca@hearthrestoration.com with: (1) your signature; (2) the copyrighted work; (3) the allegedly infringing material and its location; (4) your contact info; (5) a good‑faith statement; and (6) a statement under penalty of perjury that you are the owner or authorized agent.

11) Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEARTH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR‑FREE.

12) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEARTH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED $100 OR THE AMOUNT YOU PAID TO USE THE SITE IN THE 12 MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITS, SO SOME ABOVE MAY NOT APPLY.

13) Indemnification

You agree to defend, indemnify, and hold harmless Hearth and our affiliates, officers, directors, employees, and agents from claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your content, or your violation of these Terms or law.

14) Changes

We may modify or discontinue the Site and update these Terms. The “Last updated” date shows when changes were made. Material changes will be posted on the Site and, where required, we will provide additional notice. Continued use means you accept the updated Terms.

15) Governing law & venue

These Terms are governed by the laws of the State of Colorado (without regard to conflict‑of‑law rules). Exclusive jurisdiction and venue lie in the state and federal courts located in Larimer County, Colorado for any dispute not subject to arbitration.

16) Arbitration & class‑action waiver

At our or your election, disputes arising out of or relating to these Terms or the Site that cannot be resolved informally will be resolved by binding arbitration administered by the AAA under its Consumer Arbitration Rules. YOU AND HEARTH WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. This does not apply to small‑claims actions, IP injunctive relief, or disputes that cannot be arbitrated by law. If this section is unenforceable, disputes will be resolved in the courts specified above.

17) Suspension/termination

We may suspend or terminate access at any time if we believe you violated these Terms or used the Site in a way that could harm us or others. Sections that should survive will survive termination.

18) Miscellaneous

  • Entire agreement: These Terms and the Privacy Policy are the entire agreement regarding Site use.
  • Severability: If any provision is invalid or unenforceable, the remainder remains in effect.
  • Assignment: You may not assign these Terms without our consent; we may assign as permitted by law.
  • Waiver: Failure to enforce a provision is not a waiver.
  • Force majeure: We are not liable for delays/failures due to events beyond our control.

Service‑specific notes

  • Emergency dispatch: Requests via the Site are not guaranteed dispatch until confirmed by our team and, where required, a signed WSA or work order.
  • Insurance: We assist with documentation, but are not your insurer or adjuster and do not guarantee coverage decisions.
  • Compliance: Field work follows applicable laws, codes, and standards as reflected in signed service agreements.
